1. Who We Are
These Terms & Conditions (“Terms”) are a legal agreement between you and FennaAI Labs, Inc. (“FennaAI”, “we”, “us”, or “our”) governing your use of the FennaAI software, websites, and services (collectively, the “Service”).
2. Your Privacy & Local Processing
FennaAI is designed to run locally on your device. Your files and training data remain on your machine by default. We do not access your content, your models, or your conversations unless you explicitly share them with us for support.
3. Accounts & Eligibility
You must be capable of forming a binding contract to use the Service. If you create an account, you agree to provide accurate information and keep it up to date.
4. Your Content & Ownership
You own the content you use to teach or interact with your AI, as well as the locally produced artifacts (e.g., tuned model weights saved on your device) subject to any applicable third-party model or dataset licenses. You are responsible for ensuring you have the rights to use the content you provide.
5. Open-Source Models & Third-Party Components
FennaAI enables you to download and run open-source models and tools that may be licensed under their own terms. Those third-party terms govern your use of those components. Where there is a conflict, third-party licenses control for those components.
6. Permitted & Prohibited Use
You may use FennaAI for personal or business purposes in compliance with applicable laws. You may not use the Service to create or distribute illegal content; violate privacy or intellectual property rights; interfere with or disrupt the Service; or attempt to reverse-engineer parts of the software except where permitted by law or by an open-source license.
7. Credits & Payments
Credits, when offered, are used only for training/fine-tuning models within FennaAI. Chatting and file Q&A features are free and do not consume credits. Payments are processed by third-party providers; their terms and privacy statements apply to payment details.
8. Updates & Changes
We may provide updates to improve performance, security, compatibility, and features. The Service may change over time. Where materially impactful, we will make reasonable efforts to notify users via the app or website.
9. Beta & Experimental Features
Some features may be labeled beta or experimental and may be less stable than other parts of the Service. You use these features at your discretion.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. FennaAI Labs, Inc. disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. You are responsible for evaluating outputs and for how you use them.
11. Limitation of Liability
To the maximum extent permitted by law, FennaAI Labs, Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from or related to your use of the Service.
12. Indemnification
You agree to indemnify and hold FennaAI Labs, Inc. harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your content or your misuse of the Service.
13. Governing Law
These Terms are governed by the laws of the jurisdiction where FennaAI Labs, Inc. is established, without regard to conflict-of-laws principles. Venue and jurisdiction shall lie in the competent courts of that jurisdiction.
